These Terms of Service (“Terms”) govern your access to and use of the ordering services provided by the store (“we,” “our,” or “the store”) through this website and mobile application (collectively, the “Service”). The Service is powered by StarterByte, a technology platform that provides online ordering infrastructure to independent restaurants and cafés.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Your contract for any food, beverage, gift card, or other items ordered through the Service is between you and the store. StarterByte is not a party to your order and does not prepare, sell, or deliver food.
You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information and promptly update it if it changes.
We may suspend or terminate accounts that violate these Terms or applicable law, or where required by the store.
Estimated pickup and delivery times are estimates only and are not guarantees. Delivery is fulfilled either by the store or by third-party delivery partners. When a third-party partner delivers your order, their own terms may also apply.
You are responsible for providing an accurate delivery address and being available to receive the order. The store is not responsible for orders left at an incorrect address you provided or orders that cannot be delivered because the recipient was unavailable.
Gift cards, loyalty rewards, store credit, and promotional codes are issued by the store and subject to the store’s additional terms and any expiration or redemption restrictions communicated at the time of issue. They are not redeemable for cash except where required by law.
Menu descriptions, ingredient lists, and nutritional information are provided by the store. If you have a food allergy or dietary restriction, contact the store directly before ordering to confirm whether an item is safe for you. Cross-contact in preparation areas may occur even when allergens are not ingredients in a specific item.

The Service, including its design, software, branding, menu content, and other materials, is protected by intellectual property laws. The store and/or StarterByte (or their licensors) own all rights, title, and interest in the Service. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended personal, non-commercial purpose.
If you submit reviews, feedback, photos, or other content through the Service, you grant the store and StarterByte a worldwide, royalty-free, perpetual license to use, reproduce, and display that content in connection with operating and promoting the Service. You are responsible for content you submit and must have the rights to submit it.
Your use of the Service is also governed by our Privacy Policy and Cookie Policy, which describe how we collect, use, and protect your information.
The Service integrates with third-party services (for example, payment processors, point-of-sale systems, delivery partners, analytics, and push notification providers). Your use of those third-party services may also be governed by their own terms and privacy policies. Neither the store nor StarterByte is responsible for third-party services.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER THE STORE NOR STARTERBYTE WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID THROUGH THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain warranty disclaimers or limitations on liability, so some of the above may not apply to you.
You agree to indemnify and hold the store and StarterByte (and their officers, employees, and agents) harmless from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any law or third-party right.
We may suspend or terminate your access to the Service at any time if you violate these Terms, if required by law, or if the Service is discontinued. You may stop using the Service at any time. Sections of these Terms that by their nature should survive termination will survive (including disclaimers, limitation of liability, indemnification, and dispute provisions).
These Terms are governed by the laws of the jurisdiction in which the store is located, without regard to its conflict-of-law rules. You and the store agree to attempt in good faith to resolve any dispute informally before pursuing formal action. Where local consumer-protection laws give you stronger rights, those rights are not affected.
We may update these Terms from time to time. The “Last updated” date above reflects the most recent version. Material changes will be communicated through the Service or by other reasonable means. Your continued use of the Service after changes take effect means you accept the updated Terms.
